12Lost EquipmentE+W

(1)An Officer is guilty of an Offence if they—

(a)lose any equipment;

(b)lose any uniform.

(2)An offence under Section 12(1) is aggravated if—

(a)the item lost is within a suspect's home address;

(b)the loss is the result of any equipment or any uniform of any type being left on the roof of any Police vehicle.

(c)the item is their warrant card / ID / badge and it is deemed a total loss.

(d)in the case of BTP, the loss is the result of any equipment or any uniform of any type being left on any locamotive.

(e)if any of the 'lost items' are found on the person who initially lost the item, including but not exclusively including trouser pockets.

(3)The later recovery of any item of lost equipment or uniform, be it personally-issued or otherwise, shall not be a defence in law.

(4)Any items that are stolen from an officer, for the purposes of Section 12, will be viewed as lost.
