2POLACC / POLCOL (Police Accident / Police Collision)E+W

(1)An Officer is guilty of an Offence if they—

(a)are involved, as the driver, in a collision of any type, regardless of blame;

(b)fail to secure the handbrake of a Police vehicle, causing in to roll away causing damage;

(c)park poorly causing a member of the public (MoP) to collide with the Police vehicle;

(d)require their vehicle to be retrieved by any type of recovery, apart from in the case of a genuine breakdown.

(e)are involved in a vicinity POLAC/POLCOL;

(f)hit any animal which results in it's death;

(g)enter any body of water incompatible with the vehicle being driven;

(2)An offence under this section is aggravated if an officer—

(a)causes a total loss claim to be presumed from the extent of the damage caused.

(b)commits two or more offences under this section within one calender month.

(c)if the vehicle involved is part of the Prime Minister's convoy.

(3) A defence under Section 2 (1)(a)(b)(c) will stand if—

(a)The officer failing to secure the handbrake does so whilst fighting armed terrorists;

(b)The officer failing to secure the handbrake does so whilst fighting any armed suspect;

(c)The officer failing to secure the handbrake does so whilst fighting ANY terrorist;

(d)No damage is caused in any way to any vehicle or object;

(e)Damaged caused is part of an authorised TPAC pursuit, unless a total loss is presumed at which point the offence stands and is aggravated;
